1. General
Zeeksack AB, Reg. No. 559207-7522, (“ZEEKSACK”) is the company that provides www.zeeksack.se, hereinafter referred to as the ”Website”. The words ”we, our, ours, and us” in these terms refer to ZEEKSACK. The following terms apply to all orders placed by the customer (hereinafter referred to as ”you”) with us.
By using the Website and/or placing an order, you agree to abide by the terms set forth in this document (the ”Terms”) as well as our Privacy and Cookie Policy. This is a rather long and, objectively speaking, quite boring text, but it is important. Therefore, please ensure that you have read and understood the Terms before placing your order.
Your personal privacy is important to us. We always process personal data in accordance with applicable legislation, and we have a privacy policy that is updated in accordance with the General Data Protection Regulation (GDPR) which entered into force on May 25, 2018. We reserve the right to amend the Terms as needed, without prior notice to you. The version of the Terms that applies to your order is the version available on the Website at the time you place your order.

2. Price Information
On our Website, all prices are displayed including VAT, in accordance with applicable legislation. We specify delivery costs and estimated delivery times clearly during the payment process. Should it become necessary to split your order into multiple shipments, no extra delivery costs will be charged for the additional shipments.
Offers during special campaigns are limited to products in stock. It is not permitted to combine discount codes with other campaigns or already discounted items. If a discount code is used in conjunction with other offers that further reduce the price, Zeeksack reserves the right to invoice the customer for the price difference. We also reserve the right to terminate or modify offers at any time without prior notice.
We reserve the right to correct prices in the event of obvious errors. This includes, but is not limited to, incorrect pricing during campaigns or products mistakenly listed as free of charge. In such cases, Zeeksack has the option to cancel the order and offer the customer the opportunity to make a new purchase at the correct price.
3. Payment Options
Zeeksack offers a wide range of payment methods, including invoice, installment payment, direct payment, and card payment. The available options may vary depending on the customer's country and are presented at checkout.
Credit Check: We reserve the right to review and, if necessary, decline applications for payment by invoice or installment. For card purchases, we verify the validity of the card and available balance, as well as ensure that the buyer's details match our records.
Fees: Zeeksack is not responsible for any fees incurred due to late payments. For questions regarding this, please contact our payment partner directly.
Other: The customer must provide a valid email address when placing an order and immediately notify us of any changes. We reserve the right to send payment reminders and other notifications to the provided email address.

4. Order Process
After an order has been placed, we will send a confirmation via email. Should any obstacles arise preventing us from fulfilling your order, you will be informed of this as soon as possible. If payment has already been made for an order we cannot fulfill, you will be refunded via the same payment method used for the purchase.
In the event we assess that an order may be fraudulent, we reserve the right to cancel and refund the order. In order for us to ship the order, you need to follow the instructions we provide to identify yourself as the purchaser.
5. Formation of Contract
A purchase agreement is considered final when Zeeksack has confirmed your order and you have received an order confirmation via email. We encourage you to save this confirmation for future reference. It is possible to cancel your order up until it has been confirmed by us. Upon cancellation, any amounts paid will be refunded.
6. Delivery Information
Zeeksack is committed to handling your order with the utmost care and aims to deliver in accordance with the delivery option you have chosen. An accurate and complete delivery address is crucial to avoid delivery problems. The customer is solely responsible for any issues arising as a result of incorrect or incomplete address information.
Information about our various delivery options and associated terms can be found at checkout and on our Website. We strive to dispatch orders as quickly as possible. For certain regions, we also offer an express delivery option, which entails priority handling.
Delivery times for both standard and express delivery are presented when selecting the shipping method. Please bear in mind that actual delivery times may be affected by circumstances beyond our control. Especially during periods of high demand, deliveries may take longer than usual. If a delivery delay is of material importance to you as a customer, you have the right to terminate the purchase.
7. Goods Damaged in Transit
If you discover damage to the package or the product upon delivery, it is important that you immediately contact our customer service within a reasonable time, preferably within two days after the package was received. Please document the damage with photos and send these to us. Once we have agreed that the damage occurred during transport, we will replace damaged goods, provided they are in stock.
8. Right of Withdrawal and Returns
As a customer of Zeeksack, you have the right to withdraw from your purchase within 100 days from the date you received your order, without having to state any specific reason. To exercise your right of withdrawal, send a clear message to us with your contact details and order information. It is important that this message is sent within the withdrawal period to be considered valid.
Upon exercising the right of withdrawal, we will refund the entire purchase amount, including the shipping cost for standard delivery, as quickly as possible. The refund will be made using the same means of payment as you used for the purchase, unless otherwise agreed. The refund entails no extra costs for you.
The goods must be returned to us without undue delay, and no later than 14 days after you have notified us of your decision to exercise your right of withdrawal. A full refund is guaranteed provided that all goods are returned in their original condition. We reserve the right to deduct from the refund amount a sum corresponding to the diminution in value compared to the product's original value if the product has been used or damaged.
To facilitate the return process, please ensure that you follow our current conditions for returns, which you can find under Return Policy. It is important that the package is not sent directly into a mailbox, as these shipments risk not arriving. Save the receipt from your service point as proof.
You as the customer are responsible for the condition of the item until it has been returned to us, which means that you are also responsible for the product during return shipping. To ensure that the product is not damaged on the way back, we recommend that you pack it well.
Free returns apply only to up to five products per customer. If you have ordered more than five products and wish to return more than five items, you must bear the cost of return shipping yourself unless otherwise agreed beforehand.
9. Warranty Claims
As a customer of Zeeksack, you have the right to make a warranty claim about goods that prove to be defective or do not correspond to your order. If you discover a defect in a product, you should contact our customer service as soon as possible, and no later than within a reasonable time after the defect was discovered. We consider a warranty claim made within two months after the defect was discovered to always be within a reasonable time. However, your right to make a warranty claim ceases after three years from the receipt of the item.
Examples of defects that may entitle you to a complaint include, but are not limited to, defective seams or defective zippers. On the other hand, damage caused by normal wear and tear or improper handling is not covered by the warranty.
In the event of an approved claim, Zeeksack covers the cost of return shipping. For assistance with shipping, please contact our customer service. Approved claims are handled in accordance with the applicable Consumer Sales Act and may include repair, replacement product, or refund.
10. Digital Products
Zeeksack offers digital gift cards, which are valid for purchases on our Website. These gift cards can be purchased and used in accordance with the terms set forth here.
Prices and Payment: The value of the gift card corresponds to the amount you pay at the time of purchase. No extra fees apply. Gift cards cannot be used to purchase additional gift cards and cannot be redeemed for cash.
Right of Withdrawal and Returns: The same conditions for right of withdrawal and returns as for our physical products also apply to digital gift cards. This means a 100-day right of withdrawal from the receipt of the order.
Validity: The gift cards are valid for two years from the date of purchase. The validity period is not affected by any returns where amounts are refunded to the gift card.
11. Colors, Measurements, and Weight
We strive to accurately present and describe our products' characteristics and colors. However, it is important to note that the actual color rendering may vary depending on your screen or device.
Measurements and weights specified for our products are to be considered only as approximate estimates, intended to give a general understanding of the product's size or shape. Variations may occur based on the product's material and manufacturing.
12. Liability
Zeeksack strives for all our customers to be completely satisfied with their purchase. If for any reason you are not satisfied, we offer a money-back guarantee, provided that you follow our return conditions.
Force Majeure: We are not liable for delays or failure to our services caused by circumstances beyond our control, such as natural disasters, war, strikes, or other unforeseen events.
We attempt to resolve any disputes amicably with the customer. Should we not reach a solution, we follow the recommendations of the National Board for Consumer Disputes (ARN). The customer also has the possibility to use the EU Commission's platform for online dispute resolution to submit complaints.
13. Assignment
Zeeksack reserves the right to assign or pledge our claims, including those arising from your order, to a third party.
14. Validity of Clauses
If any part of these Terms should be deemed invalid or unenforceable, this shall not affect the validity of the remaining provisions of the agreement.
15. Intellectual Property Rights AND PROHIBITION AGAINST COPYING
We at Zeeksack dedicate great care and extensive development work to our products. Therefore, it is important for us to protect our innovations against theft and copying.
All intellectual property rights on the Website and in our products belong to Zeeksack AB. This includes, but is not limited to, trademarks, copyrights, registered designs (design protection), technical specifications, and our unique concepts such as "Activity Hook" and "Modular Divider System™".
Through your purchase, you acquire ownership of the physical copy of the product for its intended use. However, you do not acquire any rights to the underlying intellectual property rights, drawings, or construction methods.

Special conditions for traders and commercial use
If you purchase in the capacity of a trader (company), or if you as a private individual act for commercial purposes (e.g., to start a competing business), the following strict sanctions apply in the event of a breach of points A-C below.
Prohibition against Reverse Engineering and Copying
To protect our innovations, it is expressly prohibited to use our products to create competing goods. This means that you may not:
a) Copy, imitate, or recreate the product's design or function for commercial use.
b) Perform so-called "Reverse Engineering" (dismantle, analyze, or measure the product) for the purpose of understanding the construction to manufacture similar goods.
c) Assist a third party in performing acts according to point a or b.
Liquidated Damages: In the event of a breach of the prohibition against copying or reverse engineering, you shall pay to Zeeksack Liquidated Damages of SEK 250,000 per violation. If the violation is ongoing (e.g., sale of copied bags), the Liquidated Damages accrues for each commenced week that the infringement continues. This Liquidated Damages applies regardless of whether we can prove an economic loss or not.
Damages: If our actual damage (including lost profit and damage to the brand) is higher than the penalty, we are entitled to full compensation for the entire damage.
Right of Inspection: Upon reasonable suspicion that you are copying our products for commercial purposes, Zeeksack has the right, through an independent third party (e.g., auditor), to conduct an inspection of your operations to secure evidence.
A breach of point 15 constitutes a material breach of contract that entitles us to immediately terminate the purchase, stop deliveries, and take legal action.
16. Payment Terms
The seller may request payment for the item from the time it is sent from the seller to the buyer. If the buyer uses a credit or debit card for payment, the seller may reserve the purchase price on the card upon ordering. The card is charged on the same day the item is sent. When paying by invoice, the invoice is issued to the buyer when the item is sent. The payment period appears on the invoice and is at least 14 days from receipt. Buyers under the age of 18 cannot pay via subsequent invoice.
